Your access to and use of all digital products and services from NJM Insurance Group (“NJM”), including www.njm.com, the Manage Your NJM Policy service, and any other website, mobile application, or other NJM online service or application that posts a link to these Terms of Use (the “Website”), as well as any features, content, downloads, functionality, and services offered on or through the Website, regardless of how you access or use the Website, is governed by and subject to these Terms of Use. BY USING THE WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS OF USE, NJM’S ONLINE PRIVACY POLICY , AND, IF APPLICABLE, NJM’S NOTICE OF INFORMATION PRACTICES. If you do not agree with NJM’s policies and practices, your choice is to not use the Website.
NJM reserves the right to modify these Terms of Use at any time without notice, but the most current version of the Terms of Use will be available through its link on the Website. By continuing to use the services made available on this Website after the date of any modification to the Terms of Use, you agree to be bound by the rules contained in the most recent version.
These Terms of Use apply to the NJM Insurance Group of companies, which includes New Jersey Manufacturers Insurance Company, New Jersey Re-Insurance Company, New Jersey Casualty Insurance Company, and New Jersey Indemnity Insurance Company.
Products and Services
The Website is subject to change at any time. The information and descriptions on the Website are general in nature. The coverage afforded for a particular loss depends on the specific facts and the terms, exclusions, and limits of the actual policy. Nothing on this Website alters the terms or conditions of any policy, as the policy controls coverage. Coverage options, limits, discounts, deductibles, and other features are subject to underwriting criteria, state availability, and effective dates. Coverage is provided and underwritten by New Jersey Manufacturers Insurance Company and its subsidiaries, 301 Sullivan Way, West Trenton, NJ 08628. No solicitation is made by NJM to any person to use any information, materials, products, or services in any jurisdiction where the provision of such information, materials, products, and services is prohibited by law.
Privacy & Security on the Website
NJM may record or capture your activity on the Website, including where you click and items that you view. The Website is not intended for children age 16 and younger. All information we collect on the Website is subject to the NJM Online Privacy Policy and, if applicable, the NJM Notice of Information Practices. By using the Website, you consent to all actions taken by NJM with respect to your information in compliance with the NJM Online Privacy Policy and, if applicable, the NJM Notice of Information Practices.
You are responsible for informing NJM if you have changed your personal information, such as your name, telephone number, mailing address, email address, or other personal information. You may update your personal information through your Manage Your NJM Policy account or by calling NJM at 1-800-232-6600.
Trademarks & Intellectual Property Rights
All of the information and content on the Website, including but not limited to all text, graphics, photos, etc., is owned, copyrighted, or licensed by NJM and is protected by worldwide copyright laws and treaty provisions, unless otherwise indicated. The NJM name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of NJM or its affiliates or licensors. You may not use such marks without the prior and express written permission of NJM. All other names, logos, product and service names, designs, and slogans on the Website are the trademarks of their respective owners. Authorized users may print a copy of the information provided on this Website for their personal use or as otherwise authorized.
Conducting Business Electronically
This Website may offer online access to your accounts, NJM’s services, and self-help tools, including but not limited to online claims reporting services, NJM’s online Quote & Buy portal, the Manage Your NJM Policy service, online payment services, and NJM WorkSpace (the “Online Services”). Online Services also include any mobile applications NJM may offer. Through your use of the Online Services, you agree to conduct business and certain transactions with NJM electronically, including receiving information or documents through available electronic delivery methods (“Electronic Documents”). “Electronic Documents” includes correspondence, policy documents, required/policy notices, and invoices/billing documents.
In order to use the Online Services and conduct business electronically, you may be given the option to use electronic signatures in lieu of using your traditional written signature (or “wet” signature). Electronic signatures may be provided in various forms on the Website, including clicking or checking a box or engaging in a similar process as instructed online. You agree that your electronic signature has the same force and effect as your written signature. This means that you intend and agree to be bound by the terms and conditions in such electronic transaction, just as if you had signed your name to a paper document. If you do not want to conduct business electronically, you must discontinue your use of the Online Services immediately. If you have already agreed to conduct business electronically, you must withdraw your consent as described below.
Your consent does not mean that NJM must provide the Electronic Documents to you electronically, nor does your consent mean that all Electronic Documents will be delivered to you electronically. NJM may, at its discretion, provide the Electronic Documents through non-electronic means. Some documents may not be eligible for electronic delivery and will always, when applicable, be provided to you through non-electronic means. All communications, in either electronic or paper format, from NJM to you will be considered “in writing.” You may obtain paper copies of the Electronic Documents at no additional cost through your Manage Your NJM Policy account or by calling us at 1-800-232-6600. You will not be charged a fee if you contact us to request a paper copy. Requesting a paper copy in no way withdraws your consent to conduct business electronically.
Your consent to conduct business electronically with NJM does not automatically change the manner in which you currently receive documents and communications from NJM, enroll you in the GoGreen paperless program, or qualify you for any discounts which may be offered in conjunction with enrollment in the GoGreen program. Your enrollment in the GoGreen program may not be complete until you perform an additional action. Your enrollment in the GoGreen program may be subject to additional terms and conditions.
In order to access, view, sign, and retain the Electronic Documents, you must have a personal device with an internet connection; an active, valid email address with an internet service provider; and, if you wish to retain paper copies for your records, access to a printer. Your documents may be made available in a printer-friendly PDF format or as an HTML version viewable in your web browser. We recommend that you use the latest version of your device’s operating system, internet browser, and PDF viewer. Electronic Documents may not be available online indefinitely. Please save the documents to your computer or print them to retain copies for your records. If, after you consent to conduct business electronically, the hardware and software requirements for access to and retention of your documents change, such that the change creates a material risk that you will not be able to access or retain your documents, NJM will provide you with a statement advising you of the revised hardware and software requirements for access to and retention of your documents.
Through your use of the Online Services, you are confirming that you have the hardware and software described above, that you are able to receive and review Electronic Documents, that you have an active email account, and that you have provided NJM with your accurate and complete email address. You are also confirming that you are authorized to, and do, consent on behalf of all of the other account owners, authorized signers, authorized representatives, delegates, product owners, and/or service users identified with your NJM accounts, and for all other persons who are authorized by you to access your accounts.
If you are a commercial user (including NJM distribution partners, such as agents and brokers), you understand by agreeing to conduct business electronically, you affirm that you have the first named insured’s authority to give instructions and authorize transactions with respect to its insurance, including general authority over changes to its current or past products or services, or any other online transaction facilitated or permitted by the use of the Website. You understand by agreeing to conduct business electronically, you affirm that you are authorized on behalf of the first named insured to give NJM full authorization to rely and act upon any instructions received from you without further inquiry.
Your consent remains in effect until you give us notice that you are withdrawing it. To withdraw your consent to conduct business with us electronically, you may call us at 1-800-232-6600. Your withdrawal of your consent will become effective after we have had a reasonable opportunity to act upon it. If you are enrolled in GoGreen (NJM’s paperless program) or are receiving any other documents electronically, your withdrawal will cause paper documents to be mailed to you via the United States Postal Service. Your withdrawal may also result in the termination of your access to your Manage Your NJM Policy account. We will not charge you a fee to withdraw your consent, however, if you withdraw consent, we may remove any discounts applied in relation to the GoGreen program.
Accessing the Website
NJM will not be liable if, for any reason, all or any part of the Website is unavailable at any time or for any period. From time to time, NJM may restrict access to some parts of the Website, or the Website in its entirety, to users, including registered or authorized users. Access to the Website is intended for authorized users only (including but not limited to NJM policyholders and NJM distribution partners, such as agents and brokers). Actual or attempted unauthorized use of or access to the Website is prohibited.
User Responsibilities & Indemnification
If you select a User ID and Password and register to access NJM’s Manage Your NJM Policy service or any other service offered by NJM, you agree that NJM is authorized to act on instructions received under your User ID and Password without any requirement to confirm such instructions with you. You also agree that you will guard the confidentiality of your User ID and Password at all times. You also agree that you are responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms of Use and comply with them, and that you are responsible for any and all activity that occurs via your User ID and/or Password. Any unauthorized attempts to access your account must be reported immediately to NJM by calling 1-800-232-6600. You also agree that you are fully responsible for all activities that occur while accessing your account and that all information provided will be complete, true, and accurate to the best of your knowledge.
You agree, at your own expense, to defend, indemnify, and hold NJM harmless from any claim or demand (including reasonable attorneys’ fees) made by a third party in connection with, or arising out of your access to, or use of, the Website in a manner other than as expressly authorized by these Terms of Use. This includes your breach of these Terms of Use, or your violation of applicable laws or any rights of any third party.
NJM has taken all reasonable steps to protect the privacy of its customers as outlined in the NJM Online Privacy Policy and, if applicable, the NJM Notice of Information Practices. NJM is not liable for any loss incurred as a result of an unauthorized user gaining access to your account using your User ID and Password.
NJM has the right to disable any User ID, Password, or other identifier, whether chosen by you or provided by NJM, at any time in NJM’s sole discretion, for any or no reason, including if, in NJM’s opinion, you have violated any provision of these Terms of Use.
No Warranty
Neither NJM, nor its third-party service or content providers, warrants the accuracy, adequacy, completeness, or timeliness of the information, materials, products, and services on the Website or the error-free use of the Website. All information, materials, products, and services are 'as is' and 'as available,' with no warranty of any kind, express or implied, including but not limited to the warranties of title, merchantability, fitness for a particular purpose, and freedom from computer virus, is given in conjunction with the information, materials, products, and services.
Limitation of Liability
In no event shall NJM or its third-party service or content providers be liable for any damages, losses, or liabilities, including without limitation, direct or indirect, special, incidental, or consequential damages, losses, or liabilities, in connection with your use of the Website or your reliance on or use of or inability to use the information, materials, products, and services on the Website, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if NJM or its third-party service or content providers are advised of the possibility of such damages, losses or expenses.
Geographic Restrictions
The Website is operated in the United States and intended for users located in the United States. NJM does not represent that the Website is appropriate or applicable for use in any other country. Access from certain countries other than the United States may be strictly prohibited. You are responsible for compliance with all local laws, and you acknowledge and agree that you are accessing the Website on your own initiative and at your own risk. These Terms of Use shall be governed by and construed in accordance with the laws of the United States and the State of New Jersey. You consent to exclusive jurisdiction and venue in the state and federal courts in the State of New Jersey and waive the defense of forum non conveniens.
Severability & Entire Agreement
Except to the extent otherwise set forth in these Terms of Use, these Terms of Use set forth the entire understanding between NJM and you with respect to your access to (and use of) the Website. These Terms of Use replace all prior or simultaneous understandings about access and use. If any portion of these Terms and Conditions is found to be unenforceable, the remaining portions of these Terms of Use will remain in effect. NJM’s failure, in any instance, to exercise its rights under these Terms of Use will not constitute waiver of such right or any other rights under the Terms of Use.
